RGPD form, processing of personal data, management and distribution of the DirCOM newsletter.
Personal data is processed in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 94/46/EC , known as the General Data Protection Regulation, and Law No. 78-17 of 6 January 1978, as amended, on information technology, files and freedoms.
The data processing has been registered with the Université Le Havre Normandie under the reference 19032026/82/Newsletter DirCOM ULHN.
The lawfulness of processing is based on articles 6-1-e of the RGPD:
- Carrying out a mission of public interest, as set out in the French Education Code (article L.123-2) and in ULHN’s multi-year site contract (2022 – 2027), which comprises 6 strategic axes and defines objectives for each axis.
Communicating with ULHN staff and students is essential to informing them and our partners about ULHN’s activities.
The procedure is as follows: ULHN’s Communications Department distributes a newsletter to the university community; this newsletter is then distributed more widely to anyone who requests it via the ULHN website(https://www.univlehavre.fr/fr/espace-presse-et-media/), using a dedicated registration form for entering an institutional or personal e-mail address; a confirmation e-mail is then sent to the requester, who must confirm by clicking on the “Confirm” box in the body of the e-mail. It is only after this confirmation that personal data will be included in the contact file managed by the BREVO platform, whose data protection policy can be consulted at https://www.brevo.com/fr/legal/privacypolicy/.
Finally, subscribers to the Direction de la communication newsletter can unsubscribe by clicking on the unsubscribe link that always appears in the newsletter.
The purposes of the processing: the personal data mentioned below are collected:
- Manage subscriptions to newsletters distributed by the Communications Department.
- Manage electronic mailings automatically and reliably.
- Statistical monitoring (global indicators).
Recipients: the recipients of the data are the staff of the Communications Department.
Source of PCD collected: personal data is collected when a person enters his/her registration request on the ULHN website.
Nature of DCP collected: the DCP collected are the following: institutional or personal e-mail addresses of staff, students of the Université Le Havre Normandie and people from outside the ULHN.
Transfer of DCP: DCP is not transferred nationally, within the European Union and the European Economic Area, or outside Europe.
Recording and storage of DCP: The DCP collected are recorded and stored in BREVO.
DCP retention period: Université Le Havre Normandie retains the e-mail address collected as long as the person concerned does not unsubscribe (via the unsubscribe link integrated into newsletters).
Security measures: in order to protect the data collected, the following security measures have been implemented:
- legal security measures: definition of the purposes and lawfulness of processing, application of the data minimization principle, preservation of data quality, indication of personal data retention period(s), compliance with the right to information of data subjects, verification of the legal basis or lawfulness of personal data processing, compliance with the obligation to provide information to data subjects (transparency obligation), compliance with the right of access, the right of rectification, the right to erasure, the right to limit data processing, the obligation to ensure the chain of rights).
- organizational security measures: ULHN bylaws, organization chart of the Communications Department, RPGD policy for staff, users (students) and outsiders, archiving policy implemented at ULHN (archive repository: official bulletin no. 24 of June 16, 2005 and archive management table for the University of Le Havre).
- logical (IT) security measures: integrity control, backup, data and network partitioning, logical access control, traceability, operation, monitoring (parameterization, configuration controls, real-time monitoring, workstation management, protection of IT channels (networks).
- physical security measures: building access control, intruder alarm system (when ULHN is closed), locked offices, protection against non-human sources of risk (SSI), equipment security, paper document security and paper channel security.
Rights of data subjects: data subjects whose personal data is collected are informed of the following rights and may exercise them: right to information, right of access, right of rectification, right to limit processing. This processing does not give rise to automated decision-making.
Exercise of rights: in the event of difficulty in exercising their rights, the persons concerned may contact the Communications Department at the following e-mail address: communication@univ-lehavre.fr:
In the absence of a reply, the persons concerned may contact the Data Protection Officer of the Université Le Havre Normandie at the following e-mail address dpo@univ-lehavre.fr.
In the absence of a response from the Quality Department and the DPO within one month (date of receipt of requests at the Communications Department), they may send a complaint or claim to the CNIL either by submitting it on its website(https://www.cnil.fr/fr/plaintes) or by sending an e-mail by post (CNIL – Service des plaintes – 3, place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07).
